3: Operational Requirements and Client Warranty

To maintain the integrity of our delivery systems, the Client warrants and agrees to the following:

Public Visibility: You must maintain the target profile or post in "Public" mode throughout the entire delivery cycle. If a profile is set to "Private" mid-delivery, the system will mark the order as "Completed" due to a lack of access, and no refund will be issued.
Link Integrity: The Client is solely responsible for the accuracy of the URL/Link provided. Our automated system processes orders instantly based on your input; we cannot "retrieve" or "cancel" services sent to a broken or incorrect link.
Engagement Restrictions: You agree not to use any "Limit Likes" or "Restrict Comments" features that may interfere with our automated delivery nodes.

4: Comprehensive Financial and Refund Policy

At SMMGalaxy, we operate on a strictly automated ledger system.

Wallet Credit System: All payments made to SMMGalaxy are added to your internal "Wallet." These credits are used to purchase services. Once funds are deposited, they are non-refundable to your original payment source (Bank, UPI, Card).
Technical Failures: In the rare event that an order is not delivered due to a technical fault on our end, the system will automatically refund the specific order cost back to your SMMGalaxy Wallet.
Platform Purges & Drops: Social media platforms occasionally conduct "cleanup" operations to remove inactive accounts. SMMGalaxy is not responsible for "drops" caused by platform-wide updates. However, for services marked with a "Refill Guarantee," we will attempt to replenish the count within the specified period.
Anti-Fraud Protocol: Any attempt to initiate a chargeback or a reversal of a payment after the services have been initiated will be viewed as a breach of contract. We reserve the right to terminate your account and utilize legal means to recover the funds.

5: Limitation of Liability and "Use at Own Risk"

SMMGalaxy, its directors, officers, employees, and affiliates shall not be held liable for any damages—direct or indirect—resulting from the use of our services.

Account Safety: While we use the safest delivery methods available in 2026, you acknowledge that using third-party growth services carries an inherent risk. We are not responsible for shadow-bans, account suspensions, or total permanent bans issued by social media platforms.
Business Opportunity: We do not guarantee that increased social metrics will lead to increased sales, brand deals, or fame. Our service is limited to the numerical delivery of engagement.

6: Code of Conduct and Prohibited Activities

You are strictly prohibited from using the SMMGalaxy platform for:

Exploitation: Promoting or facilitating adult content, nudity, or sexually explicit materials.
Harm: Spreading hate speech, promoting violence, or inciting self-harm.
Illegality: Engaging in fraudulent schemes, phishing, or spreading malware.
Reselling Misconduct: Reselling our services without a clear disclosure to your end-clients regarding the nature of third-party SMM fulfillment.

7: Intellectual Property and Software Usage

The SMMGalaxy website, its API, and its dashboard interface are the intellectual property of SMMGalaxy. You are granted a limited, non-exclusive license to use the platform for its intended purpose. You may not:

Reverse-engineer our API or software.
Scrape data from our dashboard for competitive use.
Use our brand name or logo in a way that suggests a formal partnership without written consent.

8: Dispute Resolution and Governing Law

This agreement shall be governed by and construed in accordance with the laws of the Republic of India.

Amicable Resolution: In the event of a dispute, we encourage you to contact us via the internal ticketing system or at teamsmmgalaxy@gmail.com to resolve the matter.
Judicial Forum: If a resolution cannot be reached, you agree that any legal action or proceeding arising out of these Terms shall be brought exclusively in the courts located in New Delhi, India.

9: Force Majeure and Service Interruptions

SMMGalaxy shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to: platform-wide API outages by social media giants, internet outages, government restrictions, natural disasters, or technical "black swan" events in the global social media ecosystem.

SMMGalaxy provides its website and services on an "as is" and "as available" basis without any warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, timely, or error-free.
